reporting during inclement weather and other unusual
conditions. The changes also encourage department
heads to provide food and shelter for Essential
Personnel when they must report to campus in order
to address problems previously faced by personnel
who, due to weather, could not return home or retrieve
food. The changes also address how employees who
are paid on an hourly basis and who do not earn
leave credit will be paid for periods when the University
is closed or when the employee believes that travel
is unsafe.

Summary:
This Policy Statement has undergone a complete overhaul
to provide clarity and more specificity about the
various types of additional compensation that may
be permitted. The new title of the Policy reflects
this broader scope: “Additional Compensation
for Professional Services to the University.”
One
of the major changes is that while the previous
Policy limited all types of additional compensation
to 3/9 of the salary base for 9-month faculty, the
revised policy allows other types of incidental
compensation and compensation for summer teaching,
without specifying a limit. Instead, the process
requires pre-approval and all one-time payments
require a memo of justification for both the activity
and the compensation amount for the activity. The
Policy also sets forth the conditions required for
12-month staff to receive additional compensation.
A
new appendix provides a quick reference guide indicating
the types of additional compensation available based
on employment category.
Finally,
the policy is revised to comport with the new Board
of Governors Policy 300.2.13 (http://www.northcarolina.edu/content.php/legal/policymanual/uncpolicymanual_300_2_13.htm).

sponsoring agency at their UNC Charlotte negotiated
F&A rate. The University expects all non-federal

Summary:
This Policy is revised to add a provision permitting
the University to monitor data traffic to safeguard
the integrity of the University's computing and electronic
communication resources and to minimize the risks
to both those resources and the end users of those
resources. Specifically, the revision allows ITS to
monitor data traffic and to access, retrieve, read,
and/or disclose data communications when there is
reasonable cause to suspect a violation of applicable
University policy or criminal law, or when monitoring
is otherwise required by law. The new language in
this Policy will also be included in a network logon
banner, so that users are notified of the potential
data traffic monitoring when they log onto the University
network.

by the Department Chair and recommendation by the

has confirmed that under personnel management flexibility,

is delegated from the Board of Trustees to the Chancellor.
The

to make final decisions on appointment of emeritus

#81, with the exception of the Chancellor. In accordance
with Board of Governors Policy 300.1.6 and Regulation
300.1.6[R], Policy Statement #78 addresses four circumstances
of voluntary and involuntary relinquishments of duties
by SAAOs (other than the Chancellor): retreat to a
faculty position, reappointment of an administrator
without faculty retreat rights, separation from the
University, and retirement.

funds. The old petty cash "policy" consisted

by the adverse weather or unusual conditions are expected
to work their normal schedule. Finally, the term “hazardous”

the 2000-2001 academic year, this policy was developed
in accordance with the UNC Board of Governors’ comprehensive
new policy on copyrights. It establishes the Faculty
Copyright Education and Policy Committee and a copyright
dispute resolution mechanism. In addition the
Policy provides guidance on copyright infringement and
fair use. Finally, it establishes parameters for ownership
of various types of copyrightable works by faculty,
staff, and students. This policy is subject to modification
as the result of further discussion with the Faculty
during next year.Additionally, the Provost will call
for a review of the policy after two years of operation
under its terms.

to the State retirement system (either TSERS or the
Optional Retirement Program), and 2) the University
cannot make contributions to their health insurance

Summary:
This Policy has been changed to reflect recent revisions
to the regulations governing the Family Education Rights
and Privacy Act (FERPA). Specifically, the new FERPA
regulations now provide that the University shall give
a parent or eligible student when requested, an opportunity
for a hearing to challenge the content of the student's
education records on the grounds that the information
contained in the education records is inaccurate, misleading,
or in violation of the privacy rights of the
student. The regulations previously provided that a
student could challenge his or her education records
on the grounds that the information contained in the
records was inaccurate, misleading, or in violation
of the student's privacy or other rights.

relevant revisions to Policy Statement #69 are in Section
IV and Attachment.

resources that UNC Charlotte provides for faculty, staff,
and students are essential to carrying out the University's
primary missions of instruction, research, and public
service. Protecting and preserving University computing
and electronic communication resources is a cooperative
effort that requires each member of the University community
to act responsibly and guard against abuses. This policy
sets forth standards of responsible use, which demonstrate
respect for unobstructed access, intellectual property
rights, truth in communication, ownership of data, system
security and integrity, and individuals' rights. Responsible
use includes, but is not limited to, respecting the
rights of other users, sustaining the integrity of systems
and related physical resources, and observing all relevant
policies, laws, regulations, and contractual obligations.
Any member of the University community who violates
this policy may be subject to disciplinary action under
appropriate University disciplinary procedures.

Summary: This policy statement has been revised
to clarify a number of details related to publications
and printing at UNC Charlotte. Specifically, it now
provides that the offices of Undergraduate Admissions,
the Provost, and Publications and Printing Services
are responsible for reviewing and approving certain
major University publications that are distributed to
the general public. In addition, internal publications
for limited off-campus distribution may now be submitted
directly to the University's contract printer, instead
of submitting them to the manager of Printing Services.
However, all publications to be produced by a printer
other than the University's contract printer must be
approved by the Director of Publications and Printing
Services or the Director of Purchasing. Standards for
letterhead, envelopes, business cards, University trademarks
and service marks, and undergraduate departmental recruiting
brochures are all available from Publications and Printing
Services, and must be observed. All printing that can
be performed by the University's contract printer will
be performed by that printer, unless it requires process
color printing and is estimated to cost over $2,500,
in which case it must be sent out for bids. Finally,
the policy is revised in accordance with North Carolina
statutes requiring that statements regarding nondiscrimination
and cost of printing be printed in certain publications
and requiring certain mailing lists to be updated annually.

Summary:
A recent opinion from the North Carolina Department
of Insurance states that North Carolina Motor Fleet
Regulations, which carry the force of law, do not permit
the use of state-owned vehicles by non-state employees.
Therefore, a student must have employee status before
driving a state vehicle. Prior information from the
Department of Insurance indicated that anyone (including,
presumably, a student) could drive a state-owned vehicle
as long as he or she was a "contractual agent of
the state," and the August 24, 1998 revisions to
Policy Statement #74 reflected this understanding by
instituting a "Contractual Driver Agency Agreement"
that students could sign in order to drive a state-owned
vehicle. Based upon the recent clarification from the
Department of Insurance, however, the University was
compelled to remove that option.

Summary:
This Policy Statement, formerly entitled "Educational
Records," is renamed "Student Records"
and is reorganized and revised to include helpful headings
and subheadings that make the policy more "user-friendly"
for University students and employees to apply the law
regarding access to and disclosure of student records
(Family Educational Rights and Privacy Act-FERPA). Substantive
changes include adding "email address" to
the list of items defined as student "directory
information," which may be disclosed without a
student's consent unless the student affirmatively requests
that such information not be disclosed. In addition,
the revised policy more clearly states that only those
officials who have a "legitimate educational interest"
in the records have access to those records without
the student's prior consent. The following areas have
been added to the list of offices with personnel who
have a legitimate educational interest: Learning Center,
Career Center (replacing "Placement"), Counseling
Center, Director of Athletics, and Graduate Admissions.
Finally, the policy includes provisions related to newly
enacted statutory requirements under FERPA: Access to
Student Disciplinary Records and Parental Notification

Summary:
This policy statement has been restructured and revised
to conform with the most recent revisions to the open
meetings statutes in North Carolina. The new "Definitions"
section describes the UNC Charlotte bodies that are
considered public bodies and defines the various types
of meetings subject to the open meetings laws. The revised
"Procedures" section assigns certain notice
responsibilities to the chairs of the affected campus
committees. Under the Board of Governors' former interpretation
of the definition of a "public body" subject
to the law, only the Assistant Secretary of the Board
of Trustees carried those responsibilities. Under the
revision, the chairs of the various public bodies must
inform the Director of the Office of Public Relations
of all official meetings, and that office handles all
the technical requirements for public notice of open
meetings.
The
revised policy statement also describes the statutory
obligations for keeping minutes of all meetings, lists
the limited permissible grounds for going into a closed
session, and describes the procedures for going into
and coming out of closed sessions. Attached to the policy
statement is a "Motion to Go into Closed Session,"
specifically identifying the legal basis for meeting
in closed session, which must properly be made and adopted
at the open meeting.

Summary:
The University’s sexual harassment policy and
grievance procedures have been revised to create a single
comprehensive resource for addressing sexual harassment
matters at the University. First, two new sexual harassment
grievance procedures have been added to cover members
of the University community who were previously covered
only by generic procedures not specifically aimed at
sexual harassment. Second, the general sexual harassment
policy and all associated grievance procedures have
been consolidated to make the policy and procedures
easier to find and apply. The procedures previously
known as Policy Statement #8 and Policy Statement #10
will no longer be separately identified as policy statements.
Instead, they are simply attachments to the sexual harassment
policy, Policy Statement #61.
The
two new procedures are entitled "Grievance Procedure
for Certain Employees Exempt from the State Personnel
Act Alleging Sexual Harassment," and "Grievance
Procedure for Students Alleging Sexual Harassment by
Another Student." They provide specific methods
for addressing sexual harassment claims made by certain
EPA employees, and claims of sexual harassment of one
student by another. The addition of these new procedures
means that all students and all exempt employees now
have access to procedures designed specifically for
sexual harassment grievances. (SPA employees are covered
by procedures set forth in UNC Charlotte Personnel Information
Memorandum #35 (PIM-35),
in accordance with the State Personnel Act.)
Finally,
because the Policy Statement Series is now available
primarily online, a hyperlinked index to Policy Statement
#61 has been added at the beginning of the policy so
that it is easier to navigate, and a specific grievance
procedure can be located quickly.

Statement #57: ALCOHOLIC BEVERAGES

Summary:
The Alcoholic Beverages policy has been revised to allow
non-student groups with proper approval to serve alcohol
in areas other than the Cone Center rooms, the Cone
Center Plaza, the cafeterias, and the Rathskeller, and
to allow only non-student groups with proper approval
to serve mixed drinks only at certain limited campus
events. The revisions also add a specific requirement
that noticeably intoxicated persons may not be admitted
or served at campus events and clarify that all sales
of alcoholic beverages are prohibited. In addition,
the policy has been rearranged so that legal definitions
of certain alcoholic beverages are set forth in the
text of the policy, rather than in footnotes. The revised
policy includes a summary of the applicable State laws
governing the use and possession of alcoholic beverages
on the University campus, and includes a clear statement
that violation of the Alcoholic Beverages policy may
result in disciplinary action by the University. Finally,
the revised policy requires groups planning to serve
alcoholic beverages at a campus event to complete an
"Acknowledgement of Responsibility" form.
A "Special Circumstances Approval" form must
also be completed to obtain certain specified exceptions
to the Alcoholic Beverages policy. Both forms are included
as appendices to the policy.

This policy statement declares that UNC Charlotte is

and respectful. It defines "workplace violence"

and the Workplace Violence Coordinator. It establishes
a training and education program and sets forth institutional
procedures and remedial actions to be followed when
incidents of workplace violence occur. The policy also
establishes a Critical Response Team of administrators
to respond to critical incidents of workplace violence
affecting the University community. Finally, the Policy
includes a copy of the Workplace Violence Incident Report
to be completed as a part of the procedure to resolve
reported incidents of workplace violence.

to clarify that part-time permanent twelve-month faculty
members earn sick and annual leave on a pro rata basis,
and the maximum number of unused hours of annual leave

indicates that the Benefits Office of the Department
of Human Resources determines leave eligibility and
accrual rates.

Summary:
This policy statement has been revised to add a new
subsection (2) under the section on Responsibilities
and Procedures, requiring that injured employees shall
immediately provide notice of the accident, injury,
or occupational illness to the appropriate supervisor.
In
addition, a physician providing follow-up treatment
no longer must be deemed appropriate by both the University
and injured employee.
If
the Brocker Health Center is closed, an injured employee
will be directed to either Harrisburg Family Physicians
or the Emergency Room of University Hospital, rather
than to the Emergency Room only.
The
time in which the supervisor of the injured employee
must notify the Safety Office of the injury has been
shortened to twenty-four hours after the incident. After
initial notification, the supervisor must submit a written
investigation of the incident to the Safety Office within
three working days of the incident.

to reflect that the Department of Police and Public
Safety is responsible for raising and lowering the flags
on the UNC Charlotte campus and for seeing that they

Statement #38: SAFETY AND ENVIRONMENTAL HEALTH

Summary: The revision of this policy statement
clarifies that the Safety and Health Director has the
responsibility to plan and recommend safety and health
programs and must maintain appropriate accident records.
The Director of Personnel no longer maintains those
records. The Safety and Health Director reports to the
Vice Chancellor for Business Affairs through the Director
of Human Resources.
In
addition, the University Safety and Health Committee
is responsible for University-wide policy issues and
serves as an advisory unit to the Vice Chancellor for
Business Affairs. An operational safety committee shall
be appointed by the Chancellor to assist the University
Safety Committee in performing various functions.
Final
prioritization of funding for safety compliance rests
with the Vice Chancellor for Business Affairs, with
recommendations from specified administrators and committees.

TO THE STATE PERSONNEL ACT

Summary: This policy statement has been revised
to reflect that the Human Resources Department, rather
than the Personnel Department, has certain responsibilities
regarding classification of positions subject to the
State Personnel Act. In addition, department/office
heads and their subordinate supervisors may either prepare
or delegate the preparation of position descriptions
for new positions.
New
position or reclassification requests require the submission
of a Position Description, an Organizational Chart,
and a Checklist for Determining General Mental and Physical
Requirements to the Human Resources Department. For
new positions, the information is analyzed to determine
the appropriate classification, and a written analysis
of the proposed job content is prepared and forwarded
to the Office of State Personnel for review and final
approval. For reclassifications, the information is
analyzed to determine of the revisions in duties and
responsibilities justify reclassification.

Statement #105: THE CODE OF STUDENT ACADEMIC
INTEGRITY

Summary: This policy statement has been revised
to clarify that transient students from other institutions
enrolled in courses for credit at UNC Charlotte are
bound by the UNC Charlotte Code of Student Academic
Integrity.
In
addition, under the section on Procedures,
the previous term "Student Court Justices"
is replaced with "Student Hearing Panel Members."
Under
the section on Appeals,
the revised policy more fully sets forth the procedures
for a student appealing an adverse decision by the Hearing
Panel, including the requirement that the student must
submit a written brief in support of the appeal, separately
stating each ground upon which the student claims the
Hearing Panel committed error. The revised policy also
provides that upon review of the Hearing Panel's decision,
the Vice Chancellor for Academic Affairs may, among
other things, remand the case for a new hearing before
a Hearing Panel composed of members of the Academic
Integrity Board who have not previously participated
in the case.
Finally,
under the section on Advice
to Faculty Members, the policy includes a reminder
to faculty that intent is an element of any academic
integrity offense, and a student who submits a group
project containing material plagiarized by a second
student in the group has not violated academic integrity
unless the first student knew of the plagiarism.
