Recent Revisions to Policy Statement Series

The following Policy Statements have been revised, rescinded, or added to the University Policy Statement Series since March 1997. They are listed in reverse chronological order, according to date of revision.


Policy Statement #55, Food Storage and Preparation

Status: REVISED

Effective: November 16, 2009

The revisions to this Policy add new language to clarify some procedures and regulations, provide additional guidelines for food preparation, and update the names of Business Affairs’ units.


Policy Statement #97, Voluntary Shared Leave Program

Status: REVISED

Effective: November 11, 2009

This policy was revised to add that compensatory time, along with the previously stated sick, vacation/annual leave, and bonus leave must be exhausted prior to receiving an additional leave transfer from another employee.


Policy Statement #77, Staff Employee of the Year

Status: REVISED

Effective: November 11, 2009

This policy was revised to reflect a change to the Office of State Personnel Manual, which allows that the criterion of two or more years of continuous service for staff employee of the year awards may be waived if an employee has engaged in an act that meets the criteria of safety/heroism as set forth by the Office of State Personnel.


Policy Statement #126, Travel Authorization and Reimbursement

Status: INITIALLY APPROVED by the Chancellor

Effective: October 20, 2009

With the completion of the Travel Procedure Manual, Business Affairs has developed this new Policy Statement on Travel Authorization and Reimbursement to serve as an overarching statement regarding the purpose and scope of the travel manual, and the responsibilities of University employees while in travel status as well as the responsibilities of individuals and offices that participate in the travel authorization and reimbursement process. This is the University’s initial policy statement and procedure manual related to University travel, and it documents in one place the related federal, state, and University requirements.


Policy Statement #125, Mobile Communication Devices

Status: INITIALLY APPROVED by the Chancellor

Effective: September 23, 2009

Chancellor Dubois approved P.S.#125, Mobile Communication Devices, on September 8, 2009, effective September 23, 2009. This new policy was developed to address the use of mobile communication devices to conduct University business and the confusion surrounding various state and federal regulations regarding the use of such devices. This policy establishes guidelines for the use, documentation, and payment for these devices.


Policy Statement #45, Legal Holds

Status: INITIALLY APPROVED by the Chancellor

Effective: August 14, 2009

This new policy sets forth the policy and procedures related to retention of University records subject to a legal hold due to either a discovery order or pending or anticipated litigation.


Policy Statement #14, "Direct Deposit of Pay”

Status: APPROVED by the Chancellor

Effective: May 8, 2009

In order to promote a more efficient and cost-effective payment process, this new policy mandates direct deposit enrollment for all individuals paid through UNC Charlotte’s payroll system.

All UNC Charlotte employees who are receiving their pay by paper check shall be required to enroll in direct deposit by entering their direct deposit information into Banner Self-Service or by completing and submitting the Direct Deposit Enrollment and Change Form to Payroll prior to June 1, 2009. In accordance with federal requirements regarding direct deposit of payroll, UNC Charlotte employees may select the financial institution of his/her choice to accommodate the receipt of direct deposit payments.

All employees currently receiving their pay by direct deposit shall continue to be enrolled in the University’s direct deposit program.


Policy Statement #69, "Student Records”

Status: REVISED by the Chancellor

Effective: June 5, 2009

Policy Statement #69, Student Records, has been revised to reflect the U.S. Department of Education's amendments to the regulations implementing the Family Educational Rights and Privacy Act (FERPA), which went into effect on January 8, 2009.


Policy Statement #36, "Operation of Vehicles on University Business”

Status: REVISED by the Chancellor

Effective: May 4, 2009

Policy Statement #36, Operation of Vehicles on University Business, has been revised to clarify that the Safety and Environmental Health Offices carries approval authority over the operation of certain special services vehicles on University business.


Policy Statement #59, "Personnel Records”

Status: REVISED by the Chancellor

Effective: February 13, 2009

Policy Statement #59, Personnel Records, has been revised to reflect changes to the North Carolina Personnel Records Act (N.C.G.S. § 126 22 et seq.) and The University of North Carolina Board of Governors Policy Manual (UNC Policy 1100.3).

Additional changes to the policy statement address how and where personnel files for SPA staff should be retained on the occasion of an inter-departmental transfer.


Policy Statement #37, "Retention, Disposition, and Security of University Records”

Status: REVISED by the Chancellor

Effective: January 9, 2009

Policy Statement #37, Retention, Disposition, and Security of University Records, informs members of the University community about their duties and responsibilities with regard to the retention, disposition, and security of University records. The revisions clarify the status of Associated Entity records and strengthen instructions about the retention/disposition of records involved in audit or investigative proceedings.


Policy Statement #6, "Library Privileges”

Status: REVISED by the Chancellor

Effective: January 5, 2009

Policy Statement #6, Library Privileges, is revised to clarify certain terms and to update the policy in accordance with current practices and procedures.

Effective: October 7, 2008

The Chancellor has approved an additional revision to the recently revised Code of Student Responsibility to add the following as prohibited conduct: Commission of an act, or an attempt to commit an act, that: (i) is classified as a felony under North Carolina law; (ii) would be in violation of the General Statutes of the State of North Carolina; or (iii) would be in violation of any federal law.

The Chancellor has revised Policy Statement #8, World Wide Web, by appointing the Division of University Relations and Community Affairs to administer, interpret, and enforce the standards for the World Wide Web established in Policy Statement #8 through management of the centralized web Content Management System.

The Code of Student Responsibility has undergone major revisions, including internally re-numbering to improve navigation and references; adding and modifying various offenses and sanctions; and modifying several hearing and records retention procedures.

The Code of Student Academic Integrity has undergone a number revisions, including clarifying the applicability of the Code in grade replacement and withdrawal situations; clarifying faculty obligations to pursue academic integrity cases; clarifying that when an accused student is a graduate student, the faculty and student members of the hearing panel must include graduate faculty and a graduate student, respectively; and clarifying certain hearing and records retention procedures.


Policy Statement #69, "Student Records”

Status: REVISED by the Chancellor

Effective: May 15, 2008

The revisions to this Policy add certain offices to the list of offices with a legitimate educational interest so that those offices will be able to access and share relevant student records in performing their work.


Policy Statement #68, "Smoking on University Property”

Status: REVISED by the Chancellor

Effective: April 30, 2008

This Policy has been entirely rewritten to bring it in line with recent legislation and to provide members of the campus community with a more significant degree of protection from exposure to second-hand smoke.


Policy Statement #64, “Personnel Policies for Designated Employment Exempt from the State Personnel Act”

Status: REVISED by the Chancellor

This Policy is revised with regard to procedures for EPA non-faculty grievances to comply with corresponding changes in UNC Board of Governors’ policies.


Policy Statement #48, “Classification of Positions Subject to the State Personnel Act"

Status: REVISED by the Chancellor

Effective: March 20, 2008

This Policy is revised to conform with changes brought about by the implementation of career banding, now being implemented in phases to replace the old grade and class system.


Policy Statement #26, Equal Employment Opportunity

Status: REVISED by the Chancellor

Effective: January 1, 2008

Chancellor Dubois has approved revisions to this Policy, effective January 1, 2008, that are legally required by new provisions in the North Carolina Office of State Personnel Equal Employment Opportunity Policy.


Policy Statement #79, Control and Management of University Equipment and other Property

Status: REVISED by the Chancellor

Effective: November 29, 2007

The revisions to this Policy are intended to better control the volume of items the University is currently tracking through inventory. Specifically, the revisions increase the University’s fixed assets tracking and inventory threshold to $5,000. Previously the threshold was $5,000 for all equipment with the exception of laptops and data projectors, which had a $1,500 limit. In addition, under guidance provided by the State Controller, the University is required to track and inventory only property, plant, and equipment items costing $5,000 and above, but the University is free to set a lower threshold. Due to resource constraints, the University is opting to move the threshold for all property, plant, and equipment items to $5,000.


Policy Statement #40, Sales, Solicitations, Distribution of Materials, and Campus Displays

Status: REVISED by the Chancellor

Effective: November 14, 2007

Revisions to Policy Statement #40 have been made to add more explicit provisions governing sales on campus. Specifically, proposed revisions to the Policy provide specific conditions under which Affiliated Groups and Non-Affiliated Groups may use University facilities to carry out sales and/or sales solicitation or sales promotion activities on the University campus. Accordingly, revision is also proposed for the policy title, adding the term “Sales” at the beginning.


Policy Statement #72, Employee Suggestion System

Status: RESCINDED by the Chancellor

Effective: September 24, 2007

Because the University participates in the State Employees Incentive Bonus Program, this Policy Statement is no longer necessary. Information on the current process for submitting suggestions is outlined on the Human Resources website at http://www.hr.uncc.edu/staffinfo.htm, as well as in the SPA Employee Handbook.


Policy Statement #29, Dissemination of News

Status: REVISED by the Chancellor

Effective: September 18, 2007

Summary: The Chancellor has revised this Policy to bring it into line with current practice.


Policy Statement #51, Nondiscrimination on the Basis of Disability

Status: REVISED by the Chancellor

Effective: July 17, 2007

Summary: This Policy has been revised to:

Clarify students’ responsibility to identify themselves to the Office of Disability Services as soon as they are aware that they require assistance;

Clearly state that while the University will strongly consider requests from students that a specific type of assistive technology or academic support be provided, the University maintains the right to make a final decision about its choice of such educational aid;

Clarify procedures for bringing complaints of discrimination based on disability; and

Update office and officer titles.


Policy Statement #14, Cashing Checks

Status: RESCINDED by the Chancellor

Effective: May 23, 2007

Summary: Policy Statement #14, Cashing Checks, has been rescinded. Therefore, the University will no longer be providing check cashing services. Cashing checks is an administrative burden that consumes University resources, and the availability of ATM machines, as well as the ability to receive cash back on most debit card transactions, eliminates the need for this service.


Policy Statement #16, Final Examinations

Summary: Policy Statement #16 has been revised to account for the fact that all grades are now submitted electronically so there is more flexibility in when the grades are due.


Policy Statement #25, Violation of University Policy

Summary: This Policy has been revised to update and clarify its language.


Policy Statement #50, Purchasing Policy

Summary: This Policy has been revised due to increased purchasing authority on campus and changes to purchasing procedures.


Policy Statement #115, Export Control

Status: NEWLY APPROVED by the Chancellor

Effective: March 28, 2007

Summary: This Policy has been enacted to ensure the University's compliance with all United States export control laws and regulations.


Policy Statement #17, Space Assignment, Management, and Alteration

Status: REVISED by the Chancellor

Effective: March 20, 2007

Summary: This Policy has been revised to account for organizational and system changes within the University and the addition of research to the University’s mission; to prescribe responsibilities with regard to alteration and renovation of space; and to provide a process for requests for additional space.


Policy Statement #45, Motor Pool Vehicles

Status: RESCINDED by the Chancellor

Effective: March 22, 2007

Summary: This Policy was rescinded because it was outdated, unnecessary, and confusing to University faculty and staff trying to obtain information on our Motor Fleet program.


Policy Statement #87, Program to Prevent Use of Illegal Drugs and Alcohol Abuse

Status: REVISED by the Chancellor

Effective: March 15, 2007

Summary: The revisions to Policy Statement #87 are intended to update references and titles, add a reference to the federal Drug Free Workplace Act, clarify the role of the Counseling Center, and rectify some ambiguities in language.


Policy Statement #62, Employee Assistance Program

Status: REVISED by the Chancellor

Effective: March 15, 2007

Summary: The revisions to Policy Statement #62 reflect changes in the Employee Assistance Program, namely, replacement of references to the Counseling Center with a third party behavioral health organization, Deer Oaks.


Policy Statement #31, Privacy and Confidentiality of Individually Identifiable Health Care Information under HIPAA

Status: REVISED by the Chancellor

Effective: January 11, 2007

Summary: This Policy has been revised both to to bring it in line with current practice and in response to a recent internal audit.


Policy Statement #2, Tuition Privileges for Certain Faculty and Staff

Status: REVISED by the Board of Trustees

Effective: December 11, 2006

Summary: This Policy has been revised to conform with changes to UNC Board of Governors Policy 1000.2.2 and Regulation 1000.2.2.1[R], which increase the number of classes for which constituent institutions may waive tuition from two to three per year. A few additional changes have been made for clarification.


Policy Statement #69, Student Records

Status: REVISED

Effective: October 19, 2006

Summary: This Policy has been revised as follows:

  1. Additional University officials are listed as those with “legitimate educational interest” who, under FERPA, may have access to student education records without prior consent of the student. (See Section II.B.2)
  2. Addition of the requirements for the University to make and keep records of requests for and disclosures of education records, as required be the FERPA regulations at 34 CFR 99.31. (See Section II.D)
  3. Addition to the list of circumstances allowing disclosure of education records without prior written consent of the student: (1) Federal, State, and Local Officials and Educational Authorities, and (2) certain organizations for the purposes of Institutional Studies, as required by the FERPA regulations at 34 CFR 99.31. (See new Sections II.B.12 and II.B.13)
  4. Addition of the list of disclosures for which the University does not need to keep records those disclosures to a party seeking or receiving the records as directed by a Federal grand jury or other law enforcement subpoena when the issuing court or other issuing agency has ordered that the existence or the contents of the subpoena or the information furnished in response to the subpoena not be disclosed, as required by the FERPA regulations at 34 CFR 99.32. (See new Section II.D.5)

Policy Statement #28, Solicitation and Acceptance of Gifts

Summary: This Policy is revised primarily to bring it into compliance with current practice and recent organizational changes to the University and the UNC Charlotte Foundation..


Policy Statement #120, Cost Sharing in Sponsored Programs

Status: NEW

Effective: June 22, 2006

Summary: This Policy addresses mandatory vs. voluntary cost sharing, and distinguishes between voluntary committed cost sharing and voluntary uncommitted cost sharing. These are important distinctions, and faculty who are anticipating cost sharing in proposal budgets should review this new Policy.


Policy Statement #104, Code of Student Responsibility

Summary: The Code of Student Responsibility is revised to bring it in line with current practice and to clarify certain terms.

Policy Statement #13, Campus Operation in Adverse Weather or During Other Unusual Conditions

Status: Revision

Revision Effective: June 29, 2005

Summary: The changes to this Policy clarify which positions are deemed to be Essential Personnel for purposes of reporting during inclement weather and other unusual conditions. The changes also encourage department heads to provide food and shelter for Essential Personnel when they must report to campus in order to address problems previously faced by personnel who, due to weather, could not return home or retrieve food. The changes also address how employees who are paid on an hourly basis and who do not earn leave credit will be paid for periods when the University is closed or when the employee believes that travel is unsafe.


Policy Statement #99, Additional Compensation for Professional Services to the University

Summary: This Policy Statement has undergone a complete overhaul to provide clarity and more specificity about the various types of additional compensation that may be permitted. The new title of the Policy reflects this broader scope: “Additional Compensation for Professional Services to the University.”

One of the major changes is that while the previous Policy limited all types of additional compensation to 3/9 of the salary base for 9-month faculty, the revised policy allows other types of incidental compensation and compensation for summer teaching, without specifying a limit. Instead, the process requires pre-approval and all one-time payments require a memo of justification for both the activity and the compensation amount for the activity. The Policy also sets forth the conditions required for 12-month staff to receive additional compensation.

A new appendix provides a quick reference guide indicating the types of additional compensation available based on employment category.

Finally, the policy is revised to comport with the new Board of Governors Policy 300.2.13 (http://www.northcarolina.edu/content.php/legal/policymanual/uncpolicymanual_300_2_13.htm).


Policy Statement #62, Employee Assistance Program

Summary: This Policy required revision because the State has eliminated its administration of the Employee Assistance Program. As a result, the UNC Charlotte Counseling Center has become the University’s sole resource in employee disciplinary cases in which the University finds it necessary to mandate employee counseling as a condition of continued employment. These revisions are intended to articulate the role of the Counseling Center in addressing such employee issues without compromising the Counseling Center’s ability to provide services to students.


Policy Statement #119, Accounting for Annual Leave for FLSA-Exempt Employees Who Earn Leave

Summary: This Policy replaces PIM-47. It converts some longstanding operating rules for reporting annual leave into a University Policy Statement so that affected employees have a readily-available reference.


Policy Statement #118, Continuing Education Discount Program

Summary: The title of this Policy has been revised to more accurately reflect its subject.


Policy Statement #112, Centers and Institutes

Status: Newly approved by the Board of Trustees

Effective: December 3, 2004

Summary: This policy provides that at UNC Charlotte centers and institutes are established or discontinued at the discretion of the Chancellor, following review or evaluation by the Centers & Institutes Committee and recommendation by the Provost. The process is managed by the Vice Chancellor for Research and Federal Relations in accordance with procedures established by the Centers and Institutes Committee.


Policy Statement #118, Tuition Waiver Program

Status: Newly approved by the Board of Trustees

Effective: July 1, 2005

Summary: This policy authorizes the Director of the Office of Continuing Education, Extension, and Summer Programs to provide a discount, not to exceed 50%, on the registration fee for courses offered by that office to be charged to any "qualified employee," as that term is defined in the policy.


Policy Statement #80, Death of a Student

Status: Revised by the Chancellor

Effective: October 25, 2004

Summary: This Policy is revised to add the Career Center to the list of office on campus that the Vice Chancellor for Student Affairs should contact upon notification of the death of a student. In addition, several other office names and required actions are clarified.


Policy Statement #81, Senior Academic and Administrative Officers

Status: Revised by the Chancellor

Effective: September 27, 2004

Summary: On September 20, 2004, the Office of the President approved establishment of a new UNC Charlotte Tier I SAAO position--Vice Chancellor for Research and Federal Relations. In turn, on September 24, 2004, the UNC Charlotte Board of Trustees appointed Steve Mosier as the new Vice Chancellor for Research and Federal Relations. Therefore, the Chancellor has revised Policy Statement #81 to add the position, “Vice Chancellor for Research and Federal Relations” to the list of Tier I SAAO positions at UNC Charlotte.


Policy Statement #20, Electronic Communication Systems

Status: Revised by the Board of Trustees

Effective: September 24, 2004

Summary: The revisions to this Policy broaden the coverage of the policy from “electronic mail” to all “electronic communication systems” to ensure the appropriate use of all the University’s electronic communication systems (not only email) by its students, faculty, and staff. Accordingly, the title of the Policy has been changed to "Electronic Communication Systems.” Electronic communication systems are defined as tools provided by the University to complement traditional methods of communication and to improve education and administrative efficiency.


Policy Statement #44, Surplus Property Procedures

Status: Revised

Effective: July 15, 2004

Summary: The revisions to this Policy are based on new accounting/reporting requirements for public universities under Governmental Accounting Standards Board (GASB) Statements #34 and #35. These new requirements include tracking and reporting building and infrastructure assets. The revisions are intended to strengthen the policy with regard to accountability for lost or stolen assets. The revisions also include State and University requirements policies and procedures for operating a surplus property store on campus.


Policy Statement #79, Control and Management of University Equipment and Other Property

Status: Revised

Effective: June 4, 2004

Summary: The revisions to this Policy are intended to better control the volume of items the University is currently tracking through inventory. The Office of State Controller guidelines allow the University to select inventory levels at four different thresholds. These recommended revisions comply with Office of State Controller requirements.


Policy Statement #86, Facilities and Administrative Costs

Status: NEWLY APPROVED

Effective: May 31, 2004

Summary: Facilities and Administrative (F&A) (also known as indirect or overhead) costs are the general support expenses relating to research and sponsored programs that are incurred for common objectives of the University and therefore cannot be readily identified with a particular sponsored award. This new policy provides that F&A costs will be reimbursed by a federal sponsoring agency at their UNC Charlotte negotiated F&A rate. The University expects all non-federal sponsored programs to be reimbursed for their full costs, both direct and F&A.


Policy Statement #10, Network Security

Status: Revised

Effective: May 21, 2004

Summary: This Policy is revised to add a provision permitting the University to monitor data traffic to safeguard the integrity of the University's computing and electronic communication resources and to minimize the risks to both those resources and the end users of those resources. Specifically, the revision allows ITS to monitor data traffic and to access, retrieve, read, and/or disclose data communications when there is reasonable cause to suspect a violation of applicable University policy or criminal law, or when monitoring is otherwise required by law. The new language in this Policy will also be included in a network logon banner, so that users are notified of the potential data traffic monitoring when they log onto the University network.


Policy Statement #23, Emeritus Faculty

Status: Revised

Effective: May 11, 2004

Summary: Revisions to Policy Statement #23 reflect changes based on “Personnel Management Flexibility to Appoint and Fix Compensation of EPA Positions, Further Delegations from the Chancellor,” dated March 2003.

That document provides: “Emeritus Faculty status must be approved by the Chancellor upon nomination by the Department Chair and recommendation by the Dean, and Provost.” The Office of the President has confirmed that under personnel management flexibility, the authority to approve emeritus faculty appointments is delegated from the Board of Trustees to the Chancellor.

The revisions reflect the Chancellor’s authority to make final decisions on appointment of emeritus faculty.


Policy Statement #78, Administrative Separation and/or Retreat to a Faculty Position

Status: Newly Approved

Effective: March 5, 2004

Summary: This new Policy is established as required by The University of North Carolina Board of Governors Policy 300.1.6 and Regulation 300.1.6[R].

This Policy covers voluntary and involuntary relinquishments of duties by Senior Academic and Administrative Officers, as identified at UNC Charlotte in Policy Statement #81, with the exception of the Chancellor. In accordance with Board of Governors Policy 300.1.6 and Regulation 300.1.6[R], Policy Statement #78 addresses four circumstances of voluntary and involuntary relinquishments of duties by SAAOs (other than the Chancellor): retreat to a faculty position, reappointment of an administrator without faculty retreat rights, separation from the University, and retirement.


Policy Statement #39, Petty Cash Fund and Change Fund Policy

Status: Newly Approved

Effective: January 21, 2004

Summary: This new policy addresses petty cash funds and change funds. The old petty cash "policy" consisted of a single paragraph within Policy Statement #50, “Purchasing Policy,” and was inadequate to address the various ways petty cash is being used on campus. Specifically, the single paragraph in Policy Statement #50 did not address issues of accountability, security, replenishment, appropriate uses of petty cash funds and change funds, all of which have been addressed in this new policy.


Policy Statement #13, Campus Operation in Adverse Weather or During Other Unusual Conditions

Status: Revised

Effective: November 17, 2003

Summary: The revisions to this Policy add new provisions regarding accounting for lost time when the University is on a delayed schedule and clarify existing provisions regarding accounting for lost time when the University is closed or classes are cancelled. The revisions also specify that faculty and non-faculty employees who telework or work in alternate locations not affected by the adverse weather or unusual conditions are expected to work their normal schedule. Finally, the term “hazardous” in the title and text of the Policy Statement is changed to "adverse,” to correlate with the terminology of the State policy.


Policy Statement #69 - Student Records

Status: Revised

Effective: July 14, 2003

Summary: These revisions correspond with the Registrar's practice of releasing a student's directory information previously withheld at the student's request only after the Registrar receives the student's written authorization to do so. Formerly, if the student filed the necessary form requesting that the Registrar not release directory information, that request expired after one year. The change provides better Registrar management of student requests to withhold directory information.


 Policy Statement #104 - The Code of Student Responsibility

Status: Revised

Effective: July 1, 2003

Summary: Recent revisions comply with revisions to Section 502D(3) of The Code of the University of North Carolina and the new Policy 700.4.1 of the University of North Carolina Board of Governors. Additional substantive changes include reorganization of some provisions and clarification of terms. Substantive changes include:

1)      Revising Section 2, "Authority; Delegation; Exclusive Coverage," to comport with revisions to Section 502D(3) of The Code of the University of North Carolina;,

2)      Changing the term "student" to "party" in relevant provisions, and defining "party" to include a student or a group or organization charged with a violation of the Code

3)      Revising Section 10(o) to prohibit operating a motor vehicle under the influence alcohol or while impaired by the consumption of alcohol;

4)      Revising Section 10(v) to prohibit use of computers in University computer labs that is not related to UNC Charlotte course- and degree-related work and to prohibit violation of University Policies # 66, 67, 10, 20, and 8 on computer and software use;

5)      Revising Section 15(d), "Definite Suspension," to provide that suspension for violation of Section 10(v) may include suspension of access to University computing and electronic communication resources;

 Policy Statement #11 - Conflicts of Interest and Commitment

Summary:  Revisions eliminate the requirement that administrators provide the Chancellor with an Annual Report Summary ("ARS") about submission of EPA departmental conflicts of interest forms. However, each full-time and part-time EPA employee will continue to submit the "Annual Evaluation Form for Possible Conflicts of Interest" as required by the Board of Governors.


Policy Statement #2 - Tuition Privileges for Certain Faculty and Staff

Policy Statement #31 - Privacy and Confidentiality of Individually Identifiable Health Care                                    Information Under HIPAA

Summary: HIPAA is a 1996 federal statute with many purposes related to health care information. The new University policy statement primarily affects matters of privacy and confidentiality of health care information related to the health care activities of the Brocker Health Center and certain university offices that provide support services to Brocker Health Center.


Policy Statement #43 - Animals on Campus

Summary: Revisions make clear that animals may not be brought onto campus except in the following circumstances: (1) service animals providing assistance to disabled persons, (2) for academic research as set forth in Policy Statement #101, and (3) for a purpose specifically approved and under conditions required by the Chancellor or a vice chancellor.


Policy Statement #60 - Securing Rights to Perform Music

Summary: Revisions include 1) Agreements with music performance licensing agencies are available for inspection in the Budget Office, 2) Printed musical programs for live performances should be forwarded to the Budget Office before or within five days after such performance, 3) “Appendix A – Report of Musical Performance” and “performance fees” has been eliminated, 4) Records of musical performances will be maintained by the Budget Office, and 5) Questions regarding this policy or proper interpretation of the law should be directed to the Office of the University Attorney. 


Policy Statement #79 - Control and Management of University Equipment and Other Property

Summary:  This Policy Statement was revised to clarify and emphasize the University's responsibility to protect and preserve all University Property. Such revisions include provisions requiring that all University employees have the obligation to report actual or attempted arson, damage, theft, embezzlement, or misuse of any State-owned personal property, buildings or other real property. These revisions are partly in response to heightened scrutiny of state agency loss-control measures by North Carolina Executive Branch officials.


Policy Statement #99 - Supplemental and Summer Compensation for Professional Services to the University

Summary:  A revision to this Policy Statement clarifies that full-time faculty and EPA staff salaries can be approved by the Chancellor and Board of Trustees. 


Policy Statement #93 - Research Relations with Private Enterprise and Publication of Research Findings

Summary: Revisions to this Policy Statement 1) set out the basic subject matter of the Board of Governors' policy; 2) require that the Office of the Associate Provost for Research ensure that approved research proposals comply with the University policy; and 3) stress the need to coordinate through the Associate Provost for Research any agreement that improperly restricts the freedom of faculty and students to publish research findings.

Policy Statement #111 - Biosafety

Summary:  The revisions to this Policy Statement emphasize and better define how the biosafety process is managed on campus by addressing

1. Institutional committee responsibility for approval, registration, use, handling, and management of biohazardous agents and recombinant DNA molecules;

2. Investigator responsibility for approval, registration, possession, and use of biosafety level 2 agents, biosafety level 3 agents, Select Agents, and recombinant DNA;

3. Responsibilities of the Office of Research Services; and

4. The list of biohazardous agents designated as "Select Agents" in the Code of Federal Regulations. That list is provided as Attachment A to the policy statement.  UNC Charlotte currently does not use or contemplate use of any Select Agents.  If a request for use of a Select Agent arises in the future, procedures must be implemented to comply with federal regulations applicable to that group of agents.


Policy Statement #114 - Non-Salary Compensation for Employees Exempt from the State Personnel Act

Summary:  This policy revision includes the requirement that the President of the University of North Carolina has the authority to make all decisions concerning non-salary compensation to be provided to the Chancellor.


Effective July 1, 2001, the General Assembly authorized the Board of Governors to grant “Information Technology Management Flexibility” to any campus in The University of North Carolina.  Achieving that flexibility transfers to the Board of Trustees the authority and the responsibility for all major Information Technology (IT) initiatives on the campus, without the requirement to seek approval from the Board of Governors.  The Board of Trustees adopted new IT policies and approved revisions to existing IT policies on September 27, 2002.


Policy Statement #8 - World Wide Web Policy

Summary: This new Policy sets standards for responsible use of the University web site, web page format, accessibility, links to non-University web sites, use of the University name and registered marks on the University web site, hosting of websites for external entities, University data, and individual web pages on the University web site. 


Policy Statement #10 - Network Security Policy

Status: Newly Approved

Effective: September 27, 2002

Summary:  This new Policy is intended to ensure secure and reliable network access and performance for the University community. It addresses Internet addressing and domain services, network connections, internal services, network security, monitoring and auditing. The Policy also sets forth enforcement procedures and provides for the Chancellor to appoint a Network Security Committee to review the Policy on a regular basis and to ensure that it may be fairly interpreted and enforced.


Policy Statement #20 - Electronic Mail Policy

Status: Newly Approved

Effective: September 27, 2002

Summary: The purpose of this new Policy is to ensure the appropriate use of the University’s email systems by its students, faculty, and staff.  It addresses personal use of email, limitations on the use of email, archiving email, official University email communications, and user responsibilities.


Policy Statement #66 - Responsible Use of Computing and Electronic Communication Resources

Summary: This Policy is revised to add two new sections: “Authorization” and “Appropriate Uses,” in addition to adding a list of activities that constitute violations of the policy. The new section on Authorization sets forth the function of the user ID and password. The section on Appropriate Uses provides a list of examples of uses of computing and network resources that the University encourages. The Policy provides specific examples of policy violations to assist users in identifying inappropriate uses.

Policy Statement #114 - Non-Salary Compensation for Employees Exempt from the State Personnel Act

Summary: This new Policy Statement provides that the Board of Trustees is authorized to determine items of non-salary compensation for the Chancellor, and that the Chancellor is authorized to determine such items for other employees.


Policy Statement #2 - Tuition Privileges for Certain Faculty and Staff

Policy Statement #63 - Research Utilizing Human Subjects

Policy Statement #1 - External Professional Activities of Faculty and Other Professional Staff Exempt from the State Personnel Act

Policy Statement #105 - The Code of Student Academic Integrity

Summary: Revisions address the composition of the Academic Integrity Board (AIB) by increasing the number of faculty members serving on the AIB from twelve to thirteen to account for the addition of the new College of Information Technology. Additionally, to be consistent with recent changes in the UNC Charlotte Tenure Policies and Regulations, the number of faculty members appointed from each college is in proportion to the number of full-time faculty members with professorial rank in each college. Finally, the authority to appoint members to the AIB other than the Chair is delegated to the Senior Associate Provost.


Policy Statement #30 - Retirement Procedures and Regulations

Summary:  Substantive revisions reflect a department name change, an update to the Optional Retirement Program and investment carriers, a requirement that employees who are members of TSERS file an application for retirement at least 90 days prior to the established retirement date, removal of an obsolete paragraph from the policy, a reference to the Phased Retirement Program and modified procedures.


Policy Statement #67 - Proprietary Software

Policy Statement #14 - Cashing Checks

Policy Statement #85 - Utility Carts on Campus

Policy Statement #52: PUBLICATIONS AND UNIVERSITY ARCHIVES

Summary: Each department bears responsibility for forwarding copies of its own publications to the University Archives and the North Carolina State Publications Clearinghouse in the Department of Cultural Resources, rather than to the UNC Charlotte Publications Officer. The revisions also include clarification of the places for deposit of University publications, and a change of address for the North Carolina Publications Clearinghouse.  


Policy Statement #113: COPYRIGHT

Effective: June 1, 2001

Summary: Reviewed by the Staff Organization and approved by the Faculty Council at one of its last meetings of the 2000-2001 academic year, this policy was developed in accordance with the UNC Board of Governors’ comprehensive new policy on copyrights. It establishes the Faculty Copyright Education and Policy Committee and a copyright dispute resolution mechanism. In addition the Policy provides guidance on copyright infringement and fair use. Finally, it establishes parameters for ownership of various types of copyrightable works by faculty, staff, and students. This policy is subject to modification as the result of further discussion with the Faculty during next year.Additionally, the Provost will call for a review of the policy after two years of operation under its terms.


Policy Statement #91: MEDICAL SERVICES 

Status: Revised

Effective: June 1, 2001

Summary: The revisions authorize limited medical services at Brocker Health Center for on-campus conference and camp participants.Additionally, medical services for Postdoctoral Fellows is available on the same basis and at the same rates as the general student population. Note: This policy revision was previously incorrectly announced as being approved by the Board of Trustees on March 2, 2001.


Policy Statement #46: LEAVES OF ABSENCE FOR MEMBERS OF THE FACULTY

Summary: The Policy revision makes it easier for faculty members to understand the effects of leave on their retirement benefits and their health insurance programs.The two exceptions for faculty members who take non-FMLA personal leave without pay now included in the policy based on North Carolina statutes and State Personnel Commission rules are:1) they are not entitled to contribute to the State retirement system (either TSERS or the Optional Retirement Program), and 2) the University cannot make contributions to their health insurance programs.Employees are responsible for paying the full premium cost if they wish to continue health insurance.Additionally, an updated version of the administrative AA-32 form has been added to the online version of this Policy.


Policy Statement #7: PATENT

Policy Statement #69: STUDENT RECORDS

Summary: This Policy has been changed to reflect recent revisions to the regulations governing the Family Education Rights and Privacy Act (FERPA). Specifically, the new FERPA regulations now provide that the University shall give a parent or eligible student when requested, an opportunity for a hearing to challenge the content of the student's education records on the grounds that the information contained in the education records is inaccurate, misleading, or in violation of the privacy rights of the student. The regulations previously provided that a student could challenge his or her education records on the grounds that the information contained in the records was inaccurate, misleading, or in violation of the student's privacy or other rights.

The relevant revisions to Policy Statement #69 are in Section IV and Attachment.

Policy Statement #59: PERSONNEL RECORDS

Status: Revised

Effective: March 26, 2001

Summary: The intent of the revisions is to bring the policy into line with current practice.Most of the revisions reflect the change in practice from maintenance of EPA personnel files in the “office of the Vice Chancellor for the division” where employment was held or sought to the “department or unit” where employment was held or sought.Additionally, requests for inspection of EPA personnel records and confidential letters of recommendation should now be directed to the Director of Academic Budget and Personnel rather than to the office of the Vice Chancellor of the division in which employment was held. Additional revisions reflect other changes in practice or simple clarification of language.

Summary: This policy has been revised in light of the new regulations governing the Family Education Rights and Privacy Act (FERPA). The definition of“Education Records” is revised to clarify that “sole possession” records are, among other things, those that are “used only as a personal memory aid.” The definition of “Directory Information” is revised to add “enrollment status.” The section on disclosure of education records without prior consent of the student is revised to add a section entitled “Litigation.”The section addressing disclosure of alcohol or drug violations to parents is revised to clarify that it applies only to students who are under the age of 21 at the time of disclosure to the parent. Changes unrelated to the new FERPA regulations include an update of the cost of an official copy of a transcript, from $1 to $3, and minor editorial changes.

Policy Statement #66: RESPONSIBLE USE OF UNIVERSITY COMPUTING AND ELECTRONIC COMMUNICATION RESOURCES

Summary: The computing and electronic communication resources that UNC Charlotte provides for faculty, staff, and students are essential to carrying out the University's primary missions of instruction, research, and public service. Protecting and preserving University computing and electronic communication resources is a cooperative effort that requires each member of the University community to act responsibly and guard against abuses. This policy sets forth standards of responsible use, which demonstrate respect for unobstructed access, intellectual property rights, truth in communication, ownership of data, system security and integrity, and individuals' rights. Responsible use includes, but is not limited to, respecting the rights of other users, sustaining the integrity of systems and related physical resources, and observing all relevant policies, laws, regulations, and contractual obligations. Any member of the University community who violates this policy may be subject to disciplinary action under appropriate University disciplinary procedures.

Summary: This policy statement has been revised to clarify that the Office of Graduate Admissions, in addition to the Office of Undergraduate Admissions, is an office responsible for overseeing the editing and design of student recruitment literature.


Policy Statement #83: HAZING

Summary: The Code of Student Responsibility prohibits "hazing" and refers to Policy Statement #83 for the definition of the term. Therefore, Policy Statement #83 has been revised to provide a more clear and precise definition of "hazing." The definition also includes examples of certain activities that constitute hazing.


Policy Statement #104: CODE OF STUDENT RESPONSIBILITY

Summary: The Code of Student Responsibility is revised to clarify certain conduct standards, disciplinary procedures, and sanctions, as well as to clarify the role of the Assistant Dean of Students for Judicial Programs in the disciplinary process. Such revisions include:

  • clarifying pre-hearing and investigation procedures;
  • permitting certain hearing panels to be composed of a combination of Administrative Hearing Panel and Student Court Panel members;
  • clarifying the distinction between the disciplinary Code and the criminal justice system;
  • adding several definitions for terms used in the Code;
  • adding "setting fires," "intentionally committing acts that disrupt or interfere with the normal functions of a class," "violating University Policies…on computer and software use," and "gambling" as conduct prohibited under the Code;
  • clarifying the consequences of violating suspension or expulsion;
  • adding a provision on "Post-Enrollment Sanctions";
  • adding "whether the incident was motivated by bias" as a factor that may affect the severity of a sanction;
  • adding the definition of "charter revocation" for groups or organizations;
  • adding a provision for delaying the scheduling of hearings under certain circumstances;
  • clarifying the ability of a student to seek assistance of the Student Defense Office and the University Advocate Office where appropriate; and
  • clarifying procedures for appeals to the Chancellor and beyond.

Policy Statement #27: ALUMNI ASSOCIATION

Summary: This policy statement has been revised to bring it into conformity with current terminology, practice, and procedures. For example, the word "General" is deleted from the name of the Alumni Association to make the name consistent with the Articles of Incorporation, and the term "interest groups" is replaced by "chapters." In addition, reference to the "Annual Giving Fund" is deleted because there is no longer a fund with this name, and reference to the "Excellence Fund" is added to reflect the name of one fund into which annual contributions to the Alumni Association may be deposited. In addition, provisions have been added to reflect the means by which the Alumni Association is provided operating funds by the University and to reflect how the Alumni Association funds are managed by the University.


Policy Statement #47: PUBLICATIONS

Summary: This policy statement has been revised to clarify a number of details related to publications and printing at UNC Charlotte. Specifically, it now provides that the offices of Undergraduate Admissions, the Provost, and Publications and Printing Services are responsible for reviewing and approving certain major University publications that are distributed to the general public. In addition, internal publications for limited off-campus distribution may now be submitted directly to the University's contract printer, instead of submitting them to the manager of Printing Services. However, all publications to be produced by a printer other than the University's contract printer must be approved by the Director of Publications and Printing Services or the Director of Purchasing. Standards for letterhead, envelopes, business cards, University trademarks and service marks, and undergraduate departmental recruiting brochures are all available from Publications and Printing Services, and must be observed. All printing that can be performed by the University's contract printer will be performed by that printer, unless it requires process color printing and is estimated to cost over $2,500, in which case it must be sent out for bids. Finally, the policy is revised in accordance with North Carolina statutes requiring that statements regarding nondiscrimination and cost of printing be printed in certain publications and requiring certain mailing lists to be updated annually.

Summary: This policy has been revised to achieve consistency with recently revised regulations of the UNC Board of Governors related to Senior Academic and Administrative Officers. The Board of Governors' revised regulations designate certain employees (already covered by Policy Statement #64) as one category of "Senior Academic and Administrative Officers." Now known at UNC Charlotte as "Principal Administrators," this group consists of certain employees who were already covered by Policy Statement #64 but who were not previously considered Senior Academic and Administrative Officers. The Board of Governors' revised regulations do not result in any substantive change in coverage or in the policies and procedures under Policy Statement #64.


Policy Statement #81: SENIOR ADMINISTRATIVE OFFICERS

Summary: This Policy has been revised to achieve consistency with recently revised regulations of the UNC Board of Governors related to Senior Academic and Administrative Officers. In accordance with those regulations, this policy clearly designates employees covered by Policy Statement #81 as "Senior Administrative Officers." In the list of Senior Administrative Officers, the title of "Provost" has been change to "Provost and Vice Chancellor for Academic Affairs," and "Dean, Graduate School" has been changed to "Dean, Graduate School and Associate Vice Chancellor for Graduate Programs." Finally, Appendix I consists of the newly revised Board of Governors' regulations verbatim.


Policy Statement #74: STATE-OWNED VEHICLES

Status: Revised

Summary: A recent opinion from the North Carolina Department of Insurance states that North Carolina Motor Fleet Regulations, which carry the force of law, do not permit the use of state-owned vehicles by non-state employees. Therefore, a student must have employee status before driving a state vehicle. Prior information from the Department of Insurance indicated that anyone (including, presumably, a student) could drive a state-owned vehicle as long as he or she was a "contractual agent of the state," and the August 24, 1998 revisions to Policy Statement #74 reflected this understanding by instituting a "Contractual Driver Agency Agreement" that students could sign in order to drive a state-owned vehicle. Based upon the recent clarification from the Department of Insurance, however, the University was compelled to remove that option.


Policy Statement #69: STUDENT RECORDS

Summary: This Policy Statement, formerly entitled "Educational Records," is renamed "Student Records" and is reorganized and revised to include helpful headings and subheadings that make the policy more "user-friendly" for University students and employees to apply the law regarding access to and disclosure of student records (Family Educational Rights and Privacy Act-FERPA). Substantive changes include adding "email address" to the list of items defined as student "directory information," which may be disclosed without a student's consent unless the student affirmatively requests that such information not be disclosed. In addition, the revised policy more clearly states that only those officials who have a "legitimate educational interest" in the records have access to those records without the student's prior consent. The following areas have been added to the list of offices with personnel who have a legitimate educational interest: Learning Center, Career Center (replacing "Placement"), Counseling Center, Director of Athletics, and Graduate Admissions. Finally, the policy includes provisions related to newly enacted statutory requirements under FERPA: Access to Student Disciplinary Records and Parental Notification of Drug and Alcohol Violations.


Policy Statement #46: LEAVES OF ABSENCE FOR MEMBERS OF THE FACULTY

Summary: Former sections III.A and III. B have been reversed in order, to clarify that Personal Leave Without Pay must be granted under the Family and Medical Leave Act (FMLA), and Personal Leave With Pay is a discretionary benefit provided by the University. In addition, the reasons listed under Personal Leave Without Pay (Section III.A.1) have been revised to more clearly reflect the language of the FMLA. Finally, Section III.B.3 has been added to reiterate that taking discretionary Personal Leave With Pay reduces the amount of FMLA Personal Leave Without Pay available in any one twelve-month period.

Summary: UNC Charlotte's Purchasing Policy has been revised to conform with the new benchmark determined by the North Carolina legislature and the UNC Board of Governors. The benchmark for University purchases that must be subjected to formal competition but that do not require approval beyond the campus has been increased from $35,000 to $200,000.


Policy Statement #64: PERSONNEL POLICIES FOR DESIGNATED EMPLOYMENT EXEMPT FROM THE STATE PERSONNEL ACT

Status: Revised

Effective: September 25, 1998

Summary: This policy statement has been revised to include an effective summary of the UNC Board of Governors' policy setting time limits on appeals from dispositions of certain EPA grievances. Any appeal from a grievance decision by the Chancellor, the Board of Trustees, or the President must be filed within ten (10) days after the grievant receives a decision on the appeal from that officer or body. Provisions detailing these time limits and other appeals procedures are set forth explicitly in Section IV.F of the revised policy statement.


Policy Statement #74: STATE-OWNED VEHICLES

Status: Revised

Effective: August 24, 1998

Summary: This policy statement has been revised to require drivers of UNC Charlotte or Motor Fleet Management vans to complete and file a UNC Charlotte Van Driver Authorization Form. After January 1, 1999, all drivers of such vans must pass both a written and driving test conducted by a University-authorized tester. Non-employee students may drive University-owned vehicles not subject to Motor Fleet Management only by completing a Contractual Driver Agency Agreement. The policy also sets forth commercial licensing requirements for drivers of certain vehicles.

Policy Statement #53: OPEN MEETINGS REQUIREMENTS

Status: Revised

Effective: June 15, 1998

Summary: This policy statement has been restructured and revised to conform with the most recent revisions to the open meetings statutes in North Carolina. The new "Definitions" section describes the UNC Charlotte bodies that are considered public bodies and defines the various types of meetings subject to the open meetings laws. The revised "Procedures" section assigns certain notice responsibilities to the chairs of the affected campus committees. Under the Board of Governors' former interpretation of the definition of a "public body" subject to the law, only the Assistant Secretary of the Board of Trustees carried those responsibilities. Under the revision, the chairs of the various public bodies must inform the Director of the Office of Public Relations of all official meetings, and that office handles all the technical requirements for public notice of open meetings.

The revised policy statement also describes the statutory obligations for keeping minutes of all meetings, lists the limited permissible grounds for going into a closed session, and describes the procedures for going into and coming out of closed sessions. Attached to the policy statement is a "Motion to Go into Closed Session," specifically identifying the legal basis for meeting in closed session, which must properly be made and adopted at the open meeting.


Policy Statement #58: INTERFERENCE WITH UNIVERSITY OPERATIONS

Summary: The policy statement has been revised to add "disability" to the list of impermissible factors for the University to consider in dealing fairly and impartially with any disruption, destruction, or interference with University operations.

Policy Statement #61: SEXUAL HARASSMENT POLICY AND GRIEVANCE PROCEDURES

Summary: The University’s sexual harassment policy and grievance procedures have been revised to create a single comprehensive resource for addressing sexual harassment matters at the University. First, two new sexual harassment grievance procedures have been added to cover members of the University community who were previously covered only by generic procedures not specifically aimed at sexual harassment. Second, the general sexual harassment policy and all associated grievance procedures have been consolidated to make the policy and procedures easier to find and apply. The procedures previously known as Policy Statement #8 and Policy Statement #10 will no longer be separately identified as policy statements. Instead, they are simply attachments to the sexual harassment policy, Policy Statement #61.

The two new procedures are entitled "Grievance Procedure for Certain Employees Exempt from the State Personnel Act Alleging Sexual Harassment," and "Grievance Procedure for Students Alleging Sexual Harassment by Another Student." They provide specific methods for addressing sexual harassment claims made by certain EPA employees, and claims of sexual harassment of one student by another. The addition of these new procedures means that all students and all exempt employees now have access to procedures designed specifically for sexual harassment grievances. (SPA employees are covered by procedures set forth in UNC Charlotte Personnel Information Memorandum #35 (PIM-35), in accordance with the State Personnel Act.)

Finally, because the Policy Statement Series is now available primarily online, a hyperlinked index to Policy Statement #61 has been added at the beginning of the policy so that it is easier to navigate, and a specific grievance procedure can be located quickly.


Policy Statement #57: ALCOHOLIC BEVERAGES

Status: Revised

Effective: March 23, 1998

Summary: The Alcoholic Beverages policy has been revised to allow non-student groups with proper approval to serve alcohol in areas other than the Cone Center rooms, the Cone Center Plaza, the cafeterias, and the Rathskeller, and to allow only non-student groups with proper approval to serve mixed drinks only at certain limited campus events. The revisions also add a specific requirement that noticeably intoxicated persons may not be admitted or served at campus events and clarify that all sales of alcoholic beverages are prohibited. In addition, the policy has been rearranged so that legal definitions of certain alcoholic beverages are set forth in the text of the policy, rather than in footnotes. The revised policy includes a summary of the applicable State laws governing the use and possession of alcoholic beverages on the University campus, and includes a clear statement that violation of the Alcoholic Beverages policy may result in disciplinary action by the University. Finally, the revised policy requires groups planning to serve alcoholic beverages at a campus event to complete an "Acknowledgement of Responsibility" form. A "Special Circumstances Approval" form must also be completed to obtain certain specified exceptions to the Alcoholic Beverages policy. Both forms are included as appendices to the policy.


Policy Statement #84: OUTDOOR, ON-CAMPUS ACTIVITIES

Summary: This policy has been revised to clarify the conditions upon which certain outdoor, on-campus activities may be held in approved locations. There are explicit requirements that all approved outdoor activities must end by 11:00 p.m. and that all organizations or groups sponsoring outdoor activities must comply with University Reservations and Event Services' policies. Finally, the revisions require that any exceptions to the policy must be approved by the Vice Chancellor for Student Affairs.


Policy Statement #34: GRANTS, CONTRACTS, AND COOPERATIVE AGREEMENTS TO FINANCE SPONSORED PROGRAMS

Summary: This policy statement has been revised to reflect decentralization of handling grant and contract proposals. College deans and certain other University officials are authorized to sign specific types of grant and contract proposals. A list of those authorized to approve proposals is available in the Office of the University Attorney and the Office of Research. In addition, proposals that would impede the elimination of racial duality in the University no longer require advance approval of the President. The Proposal Approval Process Chart and the Internal Processing Form have been deleted.


Policy Statement #107: WORKPLACE VIOLENCE

Status: Newly Approved

Summary: This policy statement declares that UNC Charlotte is committed to provide a workplace that is safe, secure, and respectful. It defines "workplace violence" and sets forth the responsibilities of employees, students, and the Workplace Violence Coordinator. It establishes a training and education program and sets forth institutional procedures and remedial actions to be followed when incidents of workplace violence occur. The policy also establishes a Critical Response Team of administrators to respond to critical incidents of workplace violence affecting the University community. Finally, the Policy includes a copy of the Workplace Violence Incident Report to be completed as a part of the procedure to resolve reported incidents of workplace violence.


Policy Statement #2: TUITION PRIVILEGES FOR CERTAIN FACULTY AND STAFF

Summary: This policy statement has been revised to clarify that tuition waiver is available to eligible full-time faculty and staff during the fall and spring semesters only, and not during the summer session. Employees from other constituent institutions should contact the University Registrar for enrollment information. The University Registrar now has the authority to certify academic eligibility and space availability and will be responsible for providing the Vice Chancellor for Business Affairs with a copy of each tuition waiver application. Attachments A (Application for Faculty/Staff Tuition Waiver) and B (Procedures for faculty and staff from other constituent institutions) have also been revised.


Policy Statement #50: PURCHASING POLICY

Summary: This policy statement has been completely rewritten to classify major purchasing methods as either under State contract or not under State contract. Purchases not under State contract are classified as either purchases from University facilities, petty cash purchases, small purchases, local competitive purchases, or purchases based on sealed State bids. The policy sets forth the methods and procedures for all purchases. In addition, it provides several specified exemptions and exceptions. Finally, the policy establishes programs to ensure support of historically underutilized businesses.

Policy Statement #18: VACATION OR ANNUAL LEAVE AND SICK LEAVE FOR UNIVERSITY EMPLOYEES EXEMPT FROM THE STATE PERSONNEL ACT

Summary: This policy statement has been revised to clarify that part-time permanent twelve-month faculty members earn sick and annual leave on a pro rata basis, and the maximum number of unused hours of annual leave that may be accrued and carried forward from one year to the next shall be 240 hours. In addition, the revision indicates that the Benefits Office of the Department of Human Resources determines leave eligibility and accrual rates.


Policy Statement #49: WORKERS' COMPENSATION

Summary: This policy statement has been revised to add a new subsection (2) under the section on Responsibilities and Procedures, requiring that injured employees shall immediately provide notice of the accident, injury, or occupational illness to the appropriate supervisor.

In addition, a physician providing follow-up treatment no longer must be deemed appropriate by both the University and injured employee.

If the Brocker Health Center is closed, an injured employee will be directed to either Harrisburg Family Physicians or the Emergency Room of University Hospital, rather than to the Emergency Room only.

The time in which the supervisor of the injured employee must notify the Safety Office of the injury has been shortened to twenty-four hours after the incident. After initial notification, the supervisor must submit a written investigation of the incident to the Safety Office within three working days of the incident.


Policy Statement # 24: FLAGS

Summary: This policy statement has been revised to reflect that the Department of Police and Public Safety is responsible for raising and lowering the flags on the UNC Charlotte campus and for seeing that they are flown consistent with federal and state laws and proclamations.


Policy Statement #38: SAFETY AND ENVIRONMENTAL HEALTH

Status: Revised

Effective: April 25, 1997

Summary: The revision of this policy statement clarifies that the Safety and Health Director has the responsibility to plan and recommend safety and health programs and must maintain appropriate accident records. The Director of Personnel no longer maintains those records. The Safety and Health Director reports to the Vice Chancellor for Business Affairs through the Director of Human Resources.

In addition, the University Safety and Health Committee is responsible for University-wide policy issues and serves as an advisory unit to the Vice Chancellor for Business Affairs. An operational safety committee shall be appointed by the Chancellor to assist the University Safety Committee in performing various functions.

Final prioritization of funding for safety compliance rests with the Vice Chancellor for Business Affairs, with recommendations from specified administrators and committees.


Policy Statement #43: ANIMALS ON CAMPUS

Status: Revised

Summary: This policy statement has been revised to clarify that Policy and Public Safety, rather than Security, should be contacted to report the presence of an unattended animal on campus.


Policy Statement #48: CLASSIFICATION OF POSITIONS SUBJECT TO THE STATE PERSONNEL ACT

Status: Revised

Effective: April 25, 1997

Summary: This policy statement has been revised to reflect that the Human Resources Department, rather than the Personnel Department, has certain responsibilities regarding classification of positions subject to the State Personnel Act. In addition, department/office heads and their subordinate supervisors may either prepare or delegate the preparation of position descriptions for new positions.

New position or reclassification requests require the submission of a Position Description, an Organizational Chart, and a Checklist for Determining General Mental and Physical Requirements to the Human Resources Department. For new positions, the information is analyzed to determine the appropriate classification, and a written analysis of the proposed job content is prepared and forwarded to the Office of State Personnel for review and final approval. For reclassifications, the information is analyzed to determine of the revisions in duties and responsibilities justify reclassification.


Policy Statement #12: SECRETARIAL TIME

Status: Revised

Effective: April 24, 1997

Summary: This policy statement has been revised to encourage employees who have professional obligations to project the amount of time to be allocated to such activities, in order to avoid noncompliance with the Fair Labor Standard Act.


Policy Statement #16: FINAL EXAMINATIONS

Status: Revised

Effective: March 10, 1997

Summary: This policy statement has been revised to correct a typographical error by adding the missing word "out" after the word "filling" in subsection 4.


Policy Statement #57: ALCOHOLIC BEVERAGES

Status: Revised

Effective: March 10, 1997

Summary: This policy statement has been revised to add the Student Activity Center as an area where alcoholic beverages may be consumed at an event upon approval by the University Reservations Office.


Policy Statement #75: STUDENT APPEALS AND GRIEVANCES

Status: Revised

Effective: March 10, 1997

Summary: This policy statement has been revised to update the list of procedures established to address areas of concern to students by replacing "Student Disciplinary Governance Act" with "The Code of Student Responsibility."


Policy Statement #80: DEATH OF A STUDENT

Status: Revised

Effective: March 10, 1997

Summary: This policy statement has been revised to reflect new titles of officers who have responsibilities on the occasion of a student's death. The policy substitutes "Director of Police and Public Safety" for the previous "Director of Public Safety," "Director of Public Relations" for the previous "Director of Public Information," and "Housing and Residence Life" for the previous "Residence Life." A list of emergency contact phone numbers has been deleted.


Policy Statement #105: THE CODE OF STUDENT ACADEMIC INTEGRITY

Status: Revised

Effective: March 10, 1997

Summary: This policy statement has been revised to clarify that transient students from other institutions enrolled in courses for credit at UNC Charlotte are bound by the UNC Charlotte Code of Student Academic Integrity.

In addition, under the section on Procedures, the previous term "Student Court Justices" is replaced with "Student Hearing Panel Members."

Under the section on Appeals, the revised policy more fully sets forth the procedures for a student appealing an adverse decision by the Hearing Panel, including the requirement that the student must submit a written brief in support of the appeal, separately stating each ground upon which the student claims the Hearing Panel committed error. The revised policy also provides that upon review of the Hearing Panel's decision, the Vice Chancellor for Academic Affairs may, among other things, remand the case for a new hearing before a Hearing Panel composed of members of the Academic Integrity Board who have not previously participated in the case.

Finally, under the section on Advice to Faculty Members, the policy includes a reminder to faculty that intent is an element of any academic integrity offense, and a student who submits a group project containing material plagiarized by a second student in the group has not violated academic integrity unless the first student knew of the plagiarism.
